Esquibel loses his appeal on prison sentence

BURLEY — An Ada County man found guilty of threatening a Cassia County magistrate judge has unsuccessfully appealed his prison sentence.

Milton G. Esquibel, 47, was convicted by a jury in March on misdemeanor charges of contempt of court, disturbing the peace, resisting or obstructing an officer and making threats against a state elected official after an incident that occurred during his parents’ divorce hearing in Cassia County 5th District Court.

Gooding County 5th District Magistrate Judge Casey Robinson sentenced Esquibel to 30 days in jail in April but continued the sentencing hearing to allow Esquibel to produce medical records showing cause why he shouldn’t be incarcerated. Esquibel said during the sentencing hearing that he shouldn’t be incarcerated because he suffers from post-traumatic stress disorder allegedly stemming from abuse he suffered as a teen.

After the hearing, Esquibel filed an appeal in the Idaho Supreme Court objecting to the court’s jurisdiction over the case and claiming the court’s actions were a violation of his civil rights.

“People will go to jail and be fined by the actions of the court today,” Esquibel said during his sentencing.

Robinson said Friday during a conference call status hearing that he had received notification from the Supreme Court that Esquibel’s appeal had been conditionally dismissed.

Esquibel told Robinson that he has since filed another appeal with the district court on the same grounds.

Robinson continued the status hearing on Friday, saying he would check with the district court next week to see if the appeal had been filed and send out letters with his findings to both Esquibel and Cassia County Prosecutor Al Barrus.

Barrus could not be reached Friday afternoon for questioning on whether Esquibel has served any jail time yet.

Augustin was born on November 19, 1925 in Optimo, New Mexico, the son of Jose & Elvira Esquibel.

It was while he was Sheriff that he met and later married Gladys Bernice Montoya on February 14, 1958 in Taos, New Mexico. Together they lived and built a life in Burley, Idaho where they had three children, Russell, Milton and Gaynol Lee. They later divorced in 2009.

Esquibel has been involved in advocating Latino rights statewide as well as in Mini-Cassia for decades, serving as the chairwoman of the Idaho Commission on Hispanic Affairs as well as working with the Mexican Legal Defense and Education Fund. She was also a delegate at the Republican National Convention in 2004.

Gladys Esquibel, 69, of Burley, was sentenced Wednesday in Cassia County 5th District Court for one count of recording a false or forged public document.

Esquibel, who pleaded guilty to the charge, was sentenced to three years of supervised probation by 5th District Judge Michael Crabtree, according to Cassia County 5th District Court Records

BURLEY — An Ada County man convicted of threatening a Cassia County magistrate judge was sentenced Friday to 30 days in jail.

When 5th District Gooding County Magistrate Judge Casey Robinson told Milton Esquibel to report to jail immediately after the Friday hearing, Esquibel said he suffered from post-traumatic stress disorder and could not be incarcerated.

“I was abducted and put in a box when I was 14 years old,” said Esquibel.

Robinson gave Esquibel three weeks to file a copy of his medical records with the court to support his claim or report to jail on May 7.

Esquibel, 47, was charged in August with misdemeanor contempt of court, disturbing the peace, resisting or obstructing officers and making threats against a state elected official after an incident in a Cassia County courtroom during his parents’ divorce hearing. He was convicted March 16 by a jury.
